Court dismisses Marry Chiwenga application

Zimbabwe High Court judge Justice Judith Mushore has dismissed an application filed by Marry Chiwenga nee Mubaiwa, the embattled wife of Vice President Constantino Chiwenga, where she was seeking access to her children and matrimonial home pending the hearing of an appeal at the Supreme Court.

The Supreme Court appeal is set to be heard next month.

Marry through a ruling by High Court Judge Christopher Banda had been given access to the children as well as reside at the couple’s home.

“The application for leave to execute pending appeal is hereby dismissed. The order (Banda’s) will not be operational until the case is heard. The applicant is also ordered to pay the cost of the suit,” said the judge.

Marry is currently on bail facing charges of attempted murder, fraud, assault and money laundering.

She was arrested in December on charges of attempting to kill her husband in South Africa where he was being treated at a private hospital. She is denying all the charges
