Mandeep Tours Ordered To Pay US$145k For Fatal 2019 Crash

Mandeep Tours must pay US$145,042.94 in damages after its driver caused a fatal head-on collision in 2019. The crash occurred when their speeding bus veered into oncoming traffic, killing 13 people.

Justice Chitapi ruled the Mandeep driver, who died in the crash, was negligent after falling asleep while speeding at 110 km/h in an 80 km/h zone.

“The crash occurred in the Govasberg bus’s lane,” testified Sergeant Tibugwe, an accident evaluation expert.

The court awarded Govasberg’s owner Interplan Investments the replacement cost of their destroyed bus plus 5% annual interest. An additional US$1,120 was awarded for towing costs.

Clarion Insurance’s liability remained limited to their prior US$2,000 payment. The court dismissed claims for lost income due to insufficient evidence.

The judge rejected personal liability claims against Mandeep director Happiness Gogwe, citing corporate personality principles.
